Accident In Pony-And-Trap – Decision Awaited

Julia Prior The Judge has not yet made a decision in the case of Sally Bodey who is claiming for substantial damages against the 'driver' of a pony-and-trap in which she was travelling as a passenger. 

The 'driver' Gillian Hall lost control of the pony when Ms Bodey says it was spooked and suddenly shot forward. Ms Bodey was not wearing a riding hat at the time.

The case will involve consideration of liability for injuries caused by animals, as set out in the Animals Act 1971. This is a notorious Act among lawyers as it is commonly agreed that it is badly drafted and extremely difficult to interpret.

The Judge has 'reserved judgement' which means that he will consider the evidence and the legal issues and publish his decision at a later date. I await the Judge's decision with interest.
