Be Careful Jumping Into Swimming Pools

The High Court recently denied a claimant damages where he had dived into a private swimming pool.
The claim was brought in accordance with English law, as the accident
happened over here. The decision in Grimes v Hawkins follows the decision in Evans v Kosmar.
To dive into a shallow swimming pool carries an "obvious risk".
The pool was properly designed, competently built and well maintained. There was
nothing unusual about it and there were no hidden hazards. The risk that arose
was not from the state of the premises; rather it was caused by the risk
inherent in diving.
