£ 4,800.00 for Mrs A who sustained a fractured left leg after falling in a pothole at an outdoor concert

Our Personal Injury team has successfully settled a claim involving injuries suffered at an outdoor concert. The claimant fell into a pothole and as a result sustained a fractured fibula in her left leg. 

Mrs A had attended an outdoor concert organised by company X but held at the Defendant's property.  Mrs A was leaving the grounds and following the crowds to the exit when the accident happened.  She was not walking on a designated path due to the high volume of people attending the concert and all of whom were leaving at the same time.  As Mrs A walked along she fell in a pothole in the grass.  The area surrounding the pothole was not well lit. As a result of the accident Mrs A sustained a fractured  fibula in her left  leg.  She was in hospital for a week and in a brace support for 6 weeks.  She largely recovered within 8 months but sustained an acceleration of an asymptomatic degenerative condition of 2 years.

The Defendant did reply to our letter of claim and provided disclosure of documents that they had. They indicated that they would probably defend the claim but did not formally confirm their position. We therefore commenced court proceedings. Once these started they admitted primary liability but sought a reduction of 30% for contributory negligence. Settlement negotiations followed and the claim settled in the sum of £4,800.00 to include a small claim for travel expenses. The settlement award reflected a litigation risk but no reduction for contributory negligence was agreed or conceded.
