Q.How much will it cost me?
You may have a Legal Expense Policy as part of a household/home contents insurance policy and this may indemnify your personal injury claim. We will make enquiries with the insurer regarding this. If you have a valid legal expense policy and the insurers agree to our dealing with your claim under the terms and conditions of the policy, your claim will be funded via the policy. This is known as a before the event insurance policy.
If you don't have Legal Expense Insurance or the insurers refuse to indemnify your claim, your claim will be funded under a Conditional Fee Agreement (CFA). This is commonly referred to as a ‘no win no fee agreement’.
The CFA can be backed by a policy of insurance, known as an After the Event Insurance or ATE. We arrange this on your behalf.If your claim is unsuccessful, we shall agree to waive our fees and in the vast majority of cases you will not be liable for paying the defendants' costs. -
Q.How long will it take?
The length of a claim is dependant on a variety of factors. These include whether liability is denied and further investigation is required, whether one party blames another party for your accident and each potential responsible party has to be fully investigated, whether the medical evidence recommends treatment or further evidence from a different type of medical expert and whether court proceedings are required.
We’ll keep you fully updated on the progress and try our best to advise how long the claim will take to reach a conclusion. -
Q.What do I have to do?
Ultimately, you need to prove your case. You need to be able to provide, if available, details of witnesses, photographs and sketch plans or any other evidence that is personal to your claim. You may also need to attend one or more medical appointments and undergo treatments and x-rays/scans. You will also be expected to respond to correspondence sent to you and provide assistance on your claim when asked of you. We strongly recommend that you keep all documentation relating to your claim, particularly details of any expenses or losses you incur, for example pay slips and receipts for travel expenses and medical costs.
