Package holiday claims

At Blake Lapthorn solicitors, our travel and holiday claims lawyers can help you claim for an injury you suffered during a package holiday. The ‘injury’ may have been caused by an accident that was not your fault, an illness such as food poisoning, or infection resulting from poor hygiene.

The Package Travel, Package Holiday and Package Tours Regulations 1992 allow you to bring your claim against the tour operator or holiday provider. They are liable for the actions of those who supply services which form part of the package – for example, hotels, drivers, or restaurants.

The regulations governing package holidays avoid the need for you to bring a claim in a foreign country.

What is a ‘package holiday’?


A package holiday protected by the regulations requires the purchase of two out of the following three components at the same time:

  • Transport
  • Accommodation
  • Any excursion or significant activity

Your tour operator is liable for all aspects of your accommodation including:

  • Food and hotel facilities
  • Air travel, cruises, and transfers
  • Excursions booked with the main holiday


Where can my claim be brought?


The regulations on package holidays allow you to bring a claim in the UK against the tour operator, providing it is based in the UK. This is beneficial to you as the amount of compensation is likely to be greater, and it will be easier and quicker to pursue a claim in the UK.

How quickly should I claim?


Contact us as soon as possible, taking advantage of our free initial consultation. The time limit for a package holiday claim is three years, but it is advisable to claim as soon as possible after you know that you have suffered personal injury.
