Product liability - defective pharmaceutical product or medical device compensation claim

The Consumer Protection Act 1987 covers goods supplied to consumers including pharmaceutical products and medical devices. This can include artificial hip joints, pacemakers and other items. Such a product will be found to be defective if when supplied, it did not meet the legitimate expectations of those using it, taking into consideration the purpose of the product and any instructions or warnings issued with it.

The producer, importer or supplier of a product will be liable for a defective product on the basis of strict liability where it can be shown that the product was defective and that the defect caused injury. In these circumstances there is no requirement to prove fault or negligence, however the producer will escape a claim if they can show that at the time when the product was supplied, the defect was not discoverable within the state of knowledge at that time.
