Funding and fees
What will it cost?
Claims can be funded in different ways. We will provide advice on the type of funding that best suits your claim and personal circumstances, but this overview offers some general information.
Personal Injury
Bringing a claim for compensation for personal injury will in most cases cost you nothing.
First and foremost, if you win your case and you are paid compensation, your legal costs will be paid for by the other party, in addition to your compensation.
The payment of compensation is dealt with separately to the payment of legal costs. Your claim will be funded privately or by Conditional fee agreements or Legal expense insurance. This is known as No Win No Fee.
Clinical negligence
There are different ways in which a clinical negligence claim can be funded. Our lawyers will help you choose the one that is best suited to your personal circumstances. In addition to a conditional fee agreement (also known as 'no win no fee' agreements) and legal expense insurance, you may be able to use Public funding (legal aid) or Private funding.
Claims abroad
There are different ways in which a claim abroad can be paid for, depending on where the claim can be brought. Our friendly, expert lawyers will advise you on the options available, and help you choose the one that is best suited to your personal circumstances. As well as conditional fee agreement (also known as 'no win no fee' agreements) and legal expense insurance, you may be able to use Private funding to bring a claim.
Public funding (Legal Aid) for clinical negligence claims only
We have a clinical negligence public funding franchise from the Legal Services Commission (formerly known as the Legal Aid Board). This means that we can obtain public funding (formerly Legal Aid) if you meet the criteria set down by the Legal Services Commission. We are one of the few specialist firms that offer this currently in the country.
The Legal Services Commission will consider the strength and merits of your claim, the likelihood of success, your personal financial circumstances and the potential value of the claim when compared to the legal costs involved. Conditional fee agreement (No Win No Fee)
In a conditional fee agreement, we waive our fees if the claim is unsuccessful, also known as no win, no fee (so if your claim is successful, we recover the majority of the legal fees from your opponent). We normally recommend that all conditional fee agreement cases are supported by an after the event insurance policy to cover the cost of obtaining expert reports, medical records and court fees should we need to issue court proceedings. The policy will also cover any of your opponent’s legal fees that you are ordered to pay. You can find out more about conditional fee agreements on the website of the Law Society.
Legal expenses insurance
It’s worth checking your household insurance policy, as these often include legal expenses insurance. It may also be attached to your car insurance, so if you are involved in a car accident, this should cover the cost of pursuing a claim.
Private funding
If we act for you on a private basis, we either agree an hourly rate for the work we do or, in some cases, may agree a fixed budget to cover specific work.
