It has been recognised since the early 1900s that exposure to asbestos fibres during the course of employment or otherwise can cause individuals to develop asbestos related diseases. It is not only those working with asbestos that have a chance of contracting these but family members and others living in the vicinity of businesses using asbestos and asbestos products.
If you have a diagnosed asbestos-related condition, you may be eligible to bring a civil claim for compensation against your employers, even if they are no longer trading. Blake Lapthorn has a specialist team that can assist you with brining a claim in these circumstances.
There are different types of asbestos related diseases and each type varies in its severity. These include, pleural plaques, pleural thickening, mesothelioma, lung cancer and asbestosis.
To be successful in a claim you have to prove that the asbestos related condition that you have is as a result of exposure to asbestos by a negligent party. That is to say , they exposed you to asbestos at a time when the risks related to asbestos exposure were known and no steps were taken by them, such as the provision of protective clothing/masks, to minimise this risk and protect your health.If this link can be made, you may have a claim. However, there is an exception for the condition known as pleural plaques, which the law no longer recognises as being an injury that can be compensated for by way of a claim. However, in certain circumstances payments of £5,000.00 are being made under the Governments Pleural Plaques Compensation Scheme to individuals who are suffering from Pleural Plaques that meet certain criteria. Applications under this must be lodged by 1 August 2011 and Blake Lapthorn's Specialist Team can provide you with further guidance on this.
In all other cases a claim for an asbestos related disease must be started within three years from diagnosis with the condition. If the disease proves to be fatal then a claim must be started within three years of death or within three years of the date that the individual became aware that their illness was due to asbestos exposure.
The identity of the previous employer, who was at fault, will need to be ascertained and also its insurer. It is possible to trace insurance for companies that are no longer trading through our internal and external databases.If the company is no longer trading or insurers can not be found although a civil claim may not be possible you may be entitled to a payment from the Pneumoconiosis (Workers’ Compensation) Act 1979. We can provide further guidance on applying for a payment under this. This can also be done at the same time you are pursuing a civil claim.
If you are an individual that did not work with asbestos but contracted diffuse mesothelioma through for example being self employed or washing the clothes of an individual that worked with asbestos although you may not be able to bring a civil claim or be entitled to compensation under the 1979 act you may be entitled to a payment under the 2008 Diffuse Mesothelioma Scheme if certain conditions are met. Please note that one of these is that any claim under the scheme is made within a year of diagnosis.
