We acted for Ms E who purchased her normal face cream from an online chemist. When she used it her face came out in a rash. She checked the cream and it was out of date. It was admitted by the chemist that they were at fault for selling the product,  but they denied that the rash was as a result of the cream being out of date. They argued that she was allergic to the cream.

We obtained a report from a Consultant Dermatologist who recommended that Ms E undergo a series of patch testing to rule out an allergy to the cream. These were arranged on a private basis. The testing confirmed that it was not an allergy but irritant contact dermatitis.

Ms E suffered with a red rash on her face for one month with her skin being dry for two months after. She was awarded £5,000.
