On 18 May 2006 EAB was admitted to St Mary's Hospital in Portsmouth for complex gynaecological surgery.

The clinicians involved in her care failed to make adequate provision for post operative follow up and failed to promptly respond to indications that EAB had an obstructed bowel.

There was a delay in managing the obstructed bowel, which, despite surgical intervention, led to multi-organ failure and EAB's death on 4 June 2006.  The trust and the treating clinicians denied responsibility for her death at an inquest on 12 and 13 February 2008. The Trust's own Serious Untoward Incident Report, which was published over a year later, was critical of the care that EAB received yet the trust maintained a denial of responsibility until after the commencement of Court Proceedings.

Once proceedings were commenced, the trust made an admission of liability in full. The claim was brought on behalf of EAB's estate and her disabled son and was settled for £560,000 shortly before trial.
