Mr T had a history of sciatica, which became worse and in April 2007, he attended the A & E Department at Queen Alexandra Hospital with symptoms of increasing pain, bilateral numbness and hesitancy in passing urine. The x-rays of another Mr Thomson were reviewed and the claimant was discharged being advised to take up the back pain with his GP. Mr T saw his GP on 10 April 2007 and the diagnosis of sciatica was confirmed. The GP failed to examine Mr T.
Mr T had another consultation, this time by telephone, with another GP on 11 April 2007 who advised rest and agreed to expedite a referral for physiotherapy treatment.
On Friday 13 April 2007, Mr T was admitted as an emergency to Queen Alexandra Hospital with an acute disc prolapse or Cauda Equina Syndrome. Unfortunately, the delay in diagnosis and treatment of Cauda Equina Syndrome meant that Mr T suffered permanent loss of bowel, bladder and sexual function together with permanent pain and significant restriction in mobility. He was unable to return to work and required help and care in his day-to-day life. The claim settled shortly before trial for £800,000 together with payment of Mr T's legal costs and additional liabilities.
