Settlement for negligent hip replacement surgery

Annabelle Eyre recently achieved a settlement of £48,000 for her client, Mrs M, who instructed her following negligent hip replacement surgery.

Mrs M had been under the care of the orthopaedic clinic for a year prior to her surgery and a hip replacement was recommended following arthritic changes and increasing difficulties in mobilising her right hip. Mrs M also suffered from arthritis in her lumbar spine which had caused a pelvic tilt.

Mrs M underwent the total hip replacement surgery in September 2012. Following the surgery, Mrs M was concerned about a leg length discrepancy. On review in clinic a month later, it was noted that there was a 3cm difference. In fact, the difference was around 11 mm but because of the existing pelvic tilt, her right leg appeared to be much longer than it was pre-operatively. She was referred for orthotics and physiotherapy, neither of which helped. She was also in severe pain and had great difficulties in mobilising, requiring considerable assistance from her family.

In February 2013, the consultant confirmed that she would need a correction of the leg length discrepancy by removing the femoral stem and resecting the femoral neck further. She underwent this surgery later that month.

Post-operatively, her recovery was slow. She was reliant on a great deal of assistance and care from her family and remained reliant on one crutch when outside or away from home. She suffered from significant and unsightly scarring on her leg as a result of the revision surgery and ongoing back pain, believed to have been exacerbated by the period between the two surgeries.

The Defendant hospital trust admitted liability and Mrs M received a letter of apology from the Chief Executive. After some negotiation, the parties agreed settlement at £48,000.
