Gemma Osgood from our Clinical Negligence Team has successfully recovered £40,000.00 following a claim for compensation as a result of personal injury due to clinical negligence which occurred whilst Mr D was under the care of Portsmouth Hospitals NHS Trust in January 2013.
Mr D injured his hand on a wicker basket. He attended A & E that day and stated that he thought some of the splintered material remained. His wound was washed and an x-ray was taken. He was then discharged with no exploratory investigation.
Three days later, Mr D was suffering from pain and swelling in his hand so he returned to A&E. He was immediately transferred to another hospital via ambulance. A scan was carried out which showed that splintered material remained in his wrist and the delay in removing this had caused an infection.
Mr D continued to experience pins and needles throughout his hand as well as swelling and pain. He underwent a skin graft to re-construct the wound area. Mr D sustained nerve damage to his hand and had to undergo further surgery. He has been left with ongoing problems and significant scarring.
Mr D suffered an extended period of pain and suffering and was unable to carry out his work as a mechanic during his recovery period and experienced financial loss as a result. He has since returned to work but has had to modify his working practices to take account of his injury.
Mr D instructed BL Claims Solicitors as Specialist Clinical Negligence Solicitors. The Hospital Trust admitted liability in full and Mr D accepted £40,000.00 in full and final settlement of his claim.
