Compensation awarded following clinical negligence case at hospital

Our Clinical Negligence team has successfully recovered £17,500.00 following a claim for compensation as a result of personal injury due to clinical negligence which occurred whilst Mr B was under the care of the Royal Surrey County Hospital in March 2013.

Mr B (a child) suffered from severe autism and had problems with communication. He was sick during the night of 13 March 2013 and was walking as if in pain. Mr B was also reluctant for his mother to help him wash. Mr B's mother took him to the GP as she was worried about pain originating from the groin area. The GP asked to do a urine sample to rule out UTI. The next day the pain and swelling got worse and he was taken to A&E at 8.30pm that evening. Torsion of the left testicle was diagnosed by 9.30pm that evening. Mr B's mother expressed her concerns about her son's testicle but the hospital reassured her that an ultrasound was not required until the following morning. Mr B had not passed urine since the day before.

The ultrasound was eventually carried out at 11.15am that morning and confirmed the blood supply had been cut off. Surgery was carried out at 1.00pm that day. Mr B was not operated on until 18 hours after the onset of swelling. By then the left testicle had no blood supply to it, and had to be removed. Mr B will have to undergo insertion of a prosthetic testicle in due course. 

Mr B's medical condition meant that he did not cope well with the admission to hospital. He was very unsettled when he returned home requiring his mother to request some emergency respite care. Mr B has been left with a fear of hospitals.  

Mr B's mother instructed BL Claims Solicitors as Specialist Clinical Negligence Solicitors. The Hospital Trust admitted liability and Mr B's mother accepted £17,500.00 in full and final settlement on behalf of her son.
