Mr M became paraplegic after a road traffic accident many years ago and as has used a wheelchair ever since. Due to his spinal cord injury he would regularly self-catheterise to manage his bladder function. He noticed that he was having more urine infections and his surgeon suggested that he have a sphincterotomy to assist with bladder retention and reduce the number of infections.
Since the surgery, Mr M has suffered with a constant dribble of urine. Investigations showed the neck of his bladder had been damaged during surgery and will not fully close. Mr M finds the continual dribbling incontinence very distressing and it has affected his life greatly. Prior to this Mr M would have periods of known continence which would allow him to swim, have a shower or be intimate with a partner, without fear of dribbling. Now he does not have that period of continence.
Mr M was offered major reconstructive surgery to treat the damaged bladder neck but there is no guarantee that the surgery will be successful.
Mr M contacted BL Claims Solicitors as specialist clinical negligence solicitors. We investigated the case and sent a formal Letter of Claim to the Trust involved. Liability was admitted and following negotiations Mr M accepted £75,000 as full and final settlement of his claim.
