Failure to diagnose malunion of fractured radius

Mrs S fell onto her outstretched hand and suffered pain and swelling, she attended her local A&E department who x-rayed her wrist and diagnosed a fractured radius. The fracture was manipulated into position under local anaesthetic and a plaster of Paris was applied. She subsequently attended outpatient appointments for orthopaedic review and was told that her fracture was healing well. Eventually, she was discharged from clinic follow-up.

After six months Mrs S noticed that she was still having pain in her wrist and her grip strength in her hand was weak, Mrs S saw her GP who referred her to a second hospital for assessment by an orthopaedic surgeon.  Mrs S was seen at the second hospital and diagnosed with a significant malunion of her radius, she required surgery to correct the malunion.

Mrs S contacted BL Claims Solicitors as specialist clinical negligence solicitors. We investigated the case and sent a formal Letter of Claim to the Trust involved.  Our case was that the Defendant hospital failed to diagnose that the fracture had displaced and as a result, the opportunity for surgical intervention in the first fortnight after the accident was lost. As a result of the negligent treatment, Mrs S suffered a significant malunion that required two corrective surgeries, including an osteotomy and bone grafting from her right hip.  Liability was admitted by the Defendant and following negotiations, Mrs S accepted £25,000 in full and final settlement of her claim.
