In July of 2011, Master B fell from a trampoline and sustained a supracondylar fracture to his elbow. He attended his local hospital and the doctor advised conservative treatment in the form of an above elbow soft cast. After the cast was removed, doctors found a Varus deformity of the Humerus, known as a gunstock deformity. As a result Master B had to undergo corrective surgery in March 2013 to try to improve the alignment of his arm. Following that further surgery Master B made a good recovery and is unlikely to require any further surgery in the future, although he does have a minor permanent disability in his arm.

 

Master B's mother contacted the clinical negligence team at BL Claims solicitors. A letter of claim was sent to the Trust alleging that the care provided for Master B was below the standard acceptable and that if it had been treated properly and the deformity detected earlier, he would not have developed this deformity. Settlement was agreed in the sum of £25,000 and was approved by the Court as Master B was under 18 at the time of settlement.
