My client tripped over a raised paving stone on a pavement in a residential area but he did not report the accident to the council, as "I didn't realise I should".  He did however, attend hospital the following day who noted the cause of his injuries and had a witness, albeit not independent, his former girlfriend, who came across the immediate aftermath of the accident and saw where he fell.

The Defendant Council accepted the defect was  there and that it should have been repaired earlier, however they did not accept that the accident occurred as alleged by my client.  They maintained their denial throughout the claim and the matter proceeded to Trial.

Unfortunately we lost at Trial solely due to the fact that the accident  had not been reported to the  Council, despite the supporting  entries in his medical records and the witness evidence.   The Judge said his case failed because he did not report it to the Council.   So a lesson to be learned, if you have an accident whether it be a trip or slip or an accident at work always report it!
