In a recent case, a claimant brought a claim where the employer had failed to provide a continuous handrail along the entire length of a staircase. The Claimant tripped and fell down a small flight of stairs and onto a small landing, her momentum carried her down a longer flight of stairs resulting in injuries.

The employer was found to be in breach of its obligation to provide a suitable and sufficient handrail, but the case failed on the basis of causation as it could not be established that the presence of the handrail would have prevented her injury.

This case goes to show that just because a breach of a regulation occurs if you can't show that the breach has caused the injury the claim will fail. I feel that this was the right outcome of the evidence.
