He accidentally shot himself in the leg and claimed that the Trustees of the estate had failed in their duty to properly train him in gun safety. He sustained the injury in February 2006 while scaling a dry stone wall which collapsed beneath him.

Both barrels of the shotgun he was carrying went off and hit him at point blank range in the right calf. He suffered serious wounds and still bears the scars, despite multiple operations.

Reason for dismissing his appeal are to be handed down at a later date but I understand that it was the Defence case that Mr Whitehead had been involved with guns professionally for most of his working life and that no further training or information would have caused him to have acted differently.

You have to have sympathy for Mr Whitehead who has clearly suffered.  That the court has rejected his claim is of course very sad.  Whether it was for the right or wrong reasons, that is for you to judge.
