Fatal accident following employers' failure to ensure their workers' safety

A father of four was working for a specialist firm, who deal with ecological and forestry work. He was using a chainsaw cutting down overgrown vegetation.

He was working with a fellow employee who was using a strimmer on a near by bank. A chain had been attached to the strimmer for heavy duty work.  

Whilst undertaking his duties he was struck on the back of his neck by a piece of metal chain that flew off the strimmer at a speed of around 300 miles an hour. The impact was fatal.

On investigation by the Health and Safety Executive the employers had failed to ensure the safety of their workers, planned the work, or considered the risks of using a heavy duty piece of equipment.  

The employers pleaded guilty to breaching Health and Safety rules at Barrow Crown Court and received a fine.  The chain attachment has since been banned across Europe, and the  Health and  Safety  Executive  have urged anyone still using the attachment to dispose of it immediately.

This death could and should of been avoided if the employers had followed health and safety guidelines.
