It is one of the fundamental points of the health and safety provisions that at any workplace where pedestrians and vehicles come into contact, arrangements must be put in place to minimise the risk of an accident. In this case Costains were heavily fined because they had not put in place basic safety precautions. This was an avoidable death which is simply not acceptable in this day and age.

My colleague Claire Howard who specialises in dealing with victims of serious head and brain injuries is coincidentally acting for a client who was injured in a very similar accident on a construction site on Heathrow Terminal 5. He was also knocked down by a reversing lorry and now has permanent symptoms from his head injury, including memory and concentration problems which have affected his work.

Clearly, construction sites are dangerous places and accidents cannot always be prevented. However, that does not excuse a company which employs people to work on site from applying basic health and safety precautions, and those workers are entitled to the protection that the regulations are intended to give them.
