It is always disappointing to see an example of a case or claim that was not brought properly.

A recent case of John v Traveldev heard in the Cardiff County Court is one such example. The claim was brought incorrectly against a "tour operator" following a coach accident in Andorra in February 2008. The claim would have been better and correctly brought against the coach company or their insurer.

Unfortunately the time limit for bringing a claim in the correct way lapsed due to the very short period, normally of one year (rather than three years in England/ Wales), by which time the claim should have been commenced.

Defendants and their insurers do tend to instruct lawyers who know their way around the international aspects of a claim. Any claimant needs to make sure that their lawyer has good experience of handling foreign claims and is aware of the technical issues surrounding a claim arising from an accident abroad.
