A child was seriously injured when a branch fell off a tree and hit him, and he was lucky to survive.

His mother also suffered serious head injuries and fractures. The couple have now been charged with breaches of health and safety regulations and the case against them is ongoing. They have attended Swansea Crown Court and pleaded 'not guilty' to the breaches.

Anybody who invites the public onto their property has a duty to take reasonable steps to keep the public reasonably safe from injury. There have been previous high profile examples of injuries caused by falling branches. The property owner is expected to maintain and inspect trees on the property to make sure that they are healthy and not a danger to the public.

No doubt because of the personality involved, this case will attract much publicity when it does return to Court for Trial in November.
