I have today read a miraculous story in the Daily Mail about a man who was severely brain damaged in a road traffic accident 10 years ago and was declared in a permanent vegetative state.

His family were convinced that he had tried to communicate using his thumb but medical staff did not believe him until researchers at Cambridge University treated him using pioneering technology and he showed that he was able to answer questions in relation to his care which means that ultimately he can improve his life by trying to communicate his needs to doctors and family.

This is the first time anyone with this condition has been able to communicate to questions being asked regarding his care. The doctors were able to ask him questions and monitor his brain activity and told him to imagine playing tennis if the answer was no and yes to imagine walking around the house.

This is quite a phenomenal achievement and could have an impact on claims brought by a litigation friend on behalf of the Claimant if they are conscious and aware of the environment around them and possibly able to make decisions for themselves, although each case is different and would have to be determined by medics.
