The case of Carrick v (1) Park Resorts Limited, (2) Chiltern Health and Safety Service and (3) Richard Johnson [2012] which concerns a 25 year old male who dived into a shallow swimming pool and tragically sustained serious spinal cord injuries which rendered him Tetraplegic.

It can be difficult to establish where liability lies in cases like these,  where there may or may not have been supervision at the pool side or whether there should have been.

In this case the pool did not display adequate signage for the pool users to see prior to entering the pool and despite employing lifeguards which the owners of the park obviously felt necessary, none were deployed in the pool area when the accident occurred which could have prevented such accident from occurring.

The first Defendant subsequently displayed 5 "No Diving" signs in the pool areas. Judge A Gore QC found that the first Defendants were primarily liable and were responsible for 2/3 of full liability and the Claimant was to be found 1/3 liable.
