The hearing came about following an employee falling through a skylight after Gendex Ltd ignored safety regulations.  The employee was installing solar panels on the roof of New Milton Community Centre when he fell more than 12ft into the building.  Fortunately he managed to avoid being injured as he landed on a raised platform that broke his fall.

The Health and Safety Executive (HSE) subsequently investigated the accident and found that there were no attachment points on the roof for safety harnesses and no protection had been provided for employees working near the edge of the roof or the skylights.  Gendex Ltd had been aware of the risks but had decided it was sufficient to warn employees about the potential risk as opposed to installing any safety equipment that they considered may have damaged the roof. Gendex Ltd admitted two breaches of the Work at Height Regulations and were fined £13,000.00 and ordered to pay costs of £2,477.
