One of the first questions we are usually asked by clients is 'how much will my claim be worth?

Often this is one of the hardest questions to answer, and not something we can usually do until we have obtained independent expert advice and investigated the claim in detail. Each claim will be different and we will need to consider the individual circumstances of each case. What we can do however is explain what will be included within the claim for compensation.  Any claim for compensation for clinical negligence is made up of two elements:-

  • General damages
  • Special damages

General Damages

General damages is the sum awarded for pain, suffering and loss of amenity. The figures for general damages are determined in accordance with the Judicial Court guidelines which provide different brackets of compensation awards depending on the type of injury which has been sustained. As every case is different we will also look at previous case studies with similar circumstances to help refine the correct figure for the general damages award. 

Special Damages

Special damages will include all out of pocket expenses and past and future losses. Examples of such losses are:- 

  • loss of earnings
  • travel expenses
  • private medical treatment
  • the cost of any equipment which has been purchased
  • the cost of any care which was required (this can be claimed even if the care was provided by a family member).


Claims for special damages can be made up of both past and future losses. Anyone thinking of bringing a claim for clinical negligence should keep receipts and full details of any expenses incurred as this will help when it comes to quantifying the claim. For claims relating to fatal injuries, it is also possible to claim for funeral expenses, loss of dependency, and bereavement award.
