Many civil compensation claims follow criminal convictions, and increasingly the courts are handing out criminal compensation orders, which the abusers then have to pay to their victims.

BL Claims has just settled a claim from a client who had received a substantial sum from an abuser by way of criminal compensation. We advised our client that the criminal compensation was insufficient, and we proceeded to recover a further substantial sum from the party whom we alleged was the abuser's employers.   In fact, it is perfectly possible to sue a Defendant for compensation, even though he or she has been acquitted of the crime in question.

The same applies to the Criminal Injuries Compensation Authority.  They may pay out even though there is no conviction.  BL Claims recently recovered the sum of £60,000 from the CICA for a lady who alleged abuse by close family members, but who was unable to persuade the police to prosecute them.

Claims against individuals are perfectly viable, providing they have the assets to meet a judgment. Very often we discover that they do have those kinds of assets, and that makes a civil claim possible, particularly in circumstances where the CICA can only provide limited compensation and there is no-one else who can be held liable. Over the years, BL Claims has developed a particular expertise in finding and suing these individuals, and enforcing judgments against them by a variety of means including freezing injunctions.
