In the case of Mitsui Sumitomo Underwriting at Lloyds Ltd v Khan and Other 04/02/2014 it was held the Claimant was guilty of fraud along with a co-conspirator and both were immediately sentenced to nine months imprisonment.
Although the Claimant's wife had played a part in the conspiracy it was held she played a lesser part by providing a statement supporting the Claimant's injuries and was sentenced to seven months imprisonment suspended for two years. The Claimant had been knocked off his bicycle and had made a full recovery and was entitled to modest damages, but with the help of his wife and another concocted an elaborate fraud exaggerating the effect of the injuries.
Four doctors confirmed the claimant had permanent impaired cognitive function and made a claim for over £1 million after rejecting an offer of £75,000 from the Defendant. The Defendant hired private detectives and discovered the Claimant was functioning normally and was capable of full time work and after looking at the surveillance footage the Claimant later admitted the fraud.
