I recently read about a rather surprising decision by the Court of Appeal in a road traffic accident case. The name of the case is Gray v Botwright.

The accident happened when Gray turned right on a junction controlled by traffic lights. The traffic light for him was green and so from experience he knew that the other traffic would be on a red light.

Botwright then drove through a red light and the two cars collided.

The case was first heard in the County Court. For some reason they found that Gray was completely responsible for the accident, and so it is no surprise that he appealed against that decision.

The case was then reviewed by the Court of Appeal. They agreed that Gray was not entirely to blame and instead held that both drivers were equally liable.

This surprises me. Although I am not familiar with the particular junction, which does sound like a large and complicated one, I would expect the driver who drove through a red traffic light to be mostly if not completely to blame.

This was not a large value claim, damages were £2800 and it will probably not be worthwhile for Gray to appeal the case further.
