I note with interest from the Law Society Gazette that the NHS Litigation Authority has announced a new mediation service to speed up the process of resolving clinical negligence claims.
The service will offer the opportunity for a face to face discussion between the healthcare provider and the Claimant in the presence of an independent mediator. Using the service is voluntary and either party may resort to litigation if the process proves unsuccessful.
Any attempt by the NHS Litigation Authority to speed up the process of resolving clinical negligence disputes, particularly those of lower value, can only be a positive step for Claimants and whilst it remains to be seen how successful the scheme will be, I cautiously welcome this pro-active approach.
