I recently read an article in The Times discussing councils being hit by a tide of false injury claims.

According to a report from the Audit Commission insurance scams in which people falsely claim that they have been injured on pavements or council property have increased by more than 200% in the last year. The report details that fraudulent cases jumped from 74 in 2012/13 to 226 in 2013/14.

As a lawyer used to dealing with these types of claims I always have a criteria of information and/or evidence that I require to ensure the best chances of success in claims like these. The criteria is as follows;

  • Has the client reported the accident to the council? If not, why not?
  • Were there any witnesses to the accident?
  • Has the client attended their GP and/or hospital as a result of the accident? Do the medical entries support the accident circumstances?
  • Are there any photographs of the defect that caused the accident?

If these claims are properly investigated from the outset this should, in my opinion, prevent people from trying to pursue fraudulent claims.
