I was horrified to hear on the Today programme this morning about the Health Ombudsman's findings in their report Dying without dignity.

End of life care is almost the most important aspect of the work that nurses and doctors carry out. Communication with families and patients at this time to ensure understanding of what is happening, to enable families to be with loved ones at the end and to ensure that the patients pain and suffering is minimised is paramount.

The Ombudsman's report makes for sober reading. None of the recommendations she has made are outlandish – recognising people are dying, properly controlling symptoms, communicating effectively, providing gout of hours services and making sure that service delivery and organisation have a good death. These should be pursued as a matter of course.

As clinical negligence solicitors, we are often contacted by bereaved relatives who have had distressing experiences with their loved ones' treatment. Sometimes, we are unable to pursue claims because no breaches of duty have occurred and however, on occasion there is negligent treatment that has occurred which should not have taken place which has caused further pain and suffering to the deceased.
