BL Claims have recently been instructed by a family in respect of making a possible claim for compensation for contracting gastroenteritis and ear infections during a holiday in Ibiza, Spain in mid August 2015.

It is alleged that the gastroenteritis was a result of very poor hygiene at the resort. There was a major problem with flies in the restaurant as they were landing everywhere on plates, cutlery, tables, surfaces and food. The food was not properly covered and the hot food was generally cold. Food poisoning is one of the most common causes of gastroenteritis. The main symptom is diarrhoea, however other symptoms such as vomiting, loss of appetite, stomach cramps, aching limbs, headaches and high temperatures are sometimes experienced.

Thankfully most sufferers make a full recovery quickly, however you may be entitled to compensation for the pain and suffering along with a claim for loss of enjoyment.

As for ear infections, these may be a result of swimming pools not being cleaned properly. If there is evidence of others suffering similar symptoms from using the swimming pool at the relevant time, it is possible that the owner of the pool is liable to pay damages to those who have suffered.
