Ruth Powell acted for a woman who had a tooth wrongly removed by her dentist.
The woman was unhappy with the alignment of her teeth and had already had braces which had not resolved the problem. Her dentist advised her that she could achieve the result she wanted by using braces to sort out some overcrowding of her bottom teeth and by slightly twisting two of the front teeth.
Not long after the braces were fitted, the patient was aware that her upper teeth were moving. She brought this to attention of her dentist but nothing was done. Instead, the dentist advised the patients that it would be necessary to remove one of her lower teeth. Intuitively the patient was reluctant to have a healthy tooth extracted and questioned this treatment plan. She was assured that this was the only course of action that would create the necessary space to align her teeth. The dentist also assured the patient that no other teeth would be affected by the extraction.
This proved not to be the case and the patient was left with a significant and unsightly gap which has required further extensive treatment with braces and then a bridge, and may require an implant.
BL Claims issued proceedings against the dentist having instructed a consultant orthodontist , who concluded that the tooth had been unnecessarily and wrongly removed. Following negotiation with the dentist, she able to settle the claim for £17,000.
She was then able to pay for the dental treatment she needed.
