It is not often you get the poetic licence with which to use such famous song lyrics in this way. Given its tenuous links to what I do for a living (sadly, I am not a composer), it seems, at least to me, an ideal way to get your attention; assuming you are still reading and have not switched to iTunes to download the song! You did? Well that's great, and I welcome you back.
So what is a day in the life of a personal injury lawyer? Allow me to start by telling you what I won't be doing.
I shall not be:
1. Cold-calling potential clients. To do so would be contrary to a Solicitors Professional Code of Conduct and in any case, it's an abhorrent method of seeking work. I am not selling double glazing here.
2. Texting people saying I could get them Â£3500 for their accident claim. How and why would I want to do that? Itâ€™s a disgusting practice. If it sounds too good to be true, thatâ€™s because it is. Donâ€™t be fooled. Delete the message, immediately. Itâ€™s a scam.
3. Loitering in a hospital Accident and Emergency department in a cheap shiny suit and nasty tie in order to prey on the unsuspecting wounded. Everyone knows they have the right to seek legal advice should they suffer injury as a consequence of someone else's actions. To get that advice, you either telephone or send an email to a personal injury solicitor. The internet is a wonderful tool for finding a solicitor and therefore assuming you are reading this from our website ( www.blclaims.co.uk ) one click of the mouse will connect you to us.
4. Doing secret deals with owners of breakdown garages to obtain the contact details of those who have had the misfortune of being in a road traffic accident. Again that is contrary to a Solicitors Professional Code of Conduct. We donâ€™t do it.
Rather, my day is as follows:
1. An early start to complete this article before the deadline for submission expires!
2. I shall be calling a lady who has contacted us asking if we can help her elderly husband who has sustained a fractured hip falling down the broken stairs in his council house. That kind of injury to an elderly person is life changing. A while ago in a similar case, the same injury hasted my clients death. His family were devastated
3. I had planned to prepare the numerous bundles needed for a trial which was to be heard in two weeks at the High Court in London. That case followed the death of a young mother who was killed by a lorry whilst cycling to work. She left behind two grieving infant children. The driver and his employer denied that they were at fault and blamed the cyclist. Thankfully, at a meeting with the driver's insurers the day before yesterday, the case was settled. I should add that the Defendants did not, either through their insurer or, as is more often the case, through their Barrister, have the grace to acknowledge the loss of a loved one and apologise for their part in it. Itâ€™s a sad world.
4. Instead, my attention will turn to the case of a soldier who suffered significant injuries whilst on duty. I will be meeting with his loyal wife to discuss his difficulties coping with the trauma of what has happened to him. A personal injury lawyer is legal advisor, confidant, counsellor and friend.
5. I shall work out the financial losses of a man who fractured his ankle after falling from some dodgy scaffolding. This is a man with three school age children and a mortgage. He was bringing home Â£400 a week. His income now? Â£Nil. I am expecting the other to concede liability quite soon, but should they not, we may have a trial and in the meantime, my client's savings will drain away.
6. Towards the end of the day I shall be working out a couple of bills. "Bills?" you say. Yes and my clients, each and every one, know that if they suffer injury as a result of someone else's wrongdoing, myself and my colleagues will work tirelessly to ensure that as close as possible, we will endeavour to return them to the position they would have been in had their accident not occurred. When that is achieved, the bill for our work is sent, not to them, but to their opponent for payment. Are you aware that the government is doing its level best to pare down this 'loser pays' principle and expect you, the innocent victim, to pay towards the legal fees involved in bringing your case? You couldnâ€™t make it up.
I am often asked especially by other lawyers. "What area of practice do you work in Grant?" I reply that "I am a personal injury lawyer." "Oh, youâ€™re an ambulance chaser?" "What do you do?" They reply "I'm in banking". I say "That must be thrilling for you" and walk awayâ€¦
There's never a dull day.
