From the 10 February 2015 certain Mesothelioma sufferers and their dependants are set to receive up to an additional £54,000, thanks to new compensation rules.
Claims brought under the Government's diffuse Mesothelioma Payment Scheme will see new rules which aim to match compensation claims brought by civil action. The majority of sufferers of Mesothelioma and their families can claim compensation directly against the liability insurance held by their former employers and these types of claims will continue to receive 100% of their compensation following a recent judicial review decision.
Prior to the new rules however, where Employers Liability Insurers could not be found or the insurers no longer existed, sufferers of the asbestos related cancer and their families were only able to claim up to 80% of the average amount recovered in civil claims.
After prolonged campaigning by charities and advocacy groups including the Asbestos Victims Support, the Government have now amended the rules to ensure sufferers receive fair compensation. Now anyone who has been diagnosed with Mesothelioma from 10 February 2015 onwards and who cannot trace an insurer will be entitled to an additional amount in compensation to match the average civil claim value.
Work and Pensions Minister, Lord Freud admitted that "For years, many victims of this truly terrible disease have been failed by successive governments and the insurance industry. With this scheme we are continuing to help the many victims and families that mesothelioma has left without financial support."
Campaigners continue to argue that the scheme should be widened to compensate sufferers of all asbestos related diseases including asbestos related lung cancer, asbestosis and pleural thickening and not be limited to solely Mesothelioma victims.
